Artists I work closely with or offer packages with, and recommend!

GENERAL

Both parties must understand the expectations and framework of the project before the commission is started and the initial payment is made.I am entitled to cancel or deny a commission for any reason. Reasoning will be disclosed upon request by the Client. If I choose to cancel the commission (due to personal reasons, without the client breaking TOS) I will refund any payments made by the Client towards the commission fee in full.

PAYMENTS

Upon accepting your commission, the first payment will be made and considered a 'deposit.' A deposit must be made to secure a slot on the waiting list, and must be paid before work begins.In regards to payment plans, the client will only receive files, test or final, when the full amount is paid off.

REFUNDS

Refunds will be given only under the sole discretion of the Artist within the following scenarios:The deadline was not met; in this case, any additional rush fee will be refunded in full.If the Client wishes to—without reason—cancel the commission before the Artist has spent 3 hours working on the commission.
Failure to adhere to the Terms of Service outlined here may—at the Artist's sole discretion—result in the immediate cancellation of your commission without refund.

REVISIONS

Upon delivery of drafts or test files, revisions can be requested. After a revision is approved, it be considered part of the finished project. If there are further revisions the client deems necessary- as in revisions of work that was already approved- they may be subject to additional revision fees.Major revisions are not accepted without additional fee and time added to the deadline once 75% of the project is completed.Upon delivery of finished work, no revisions can be made. Any further changes will be outside the scope of the original commission, and will be considered 'add-ons', or may not be accepted at all if considered unreasonable.

DEADLINES AND DELIVERYIf the work needs to be completed and delivered by a specified date, an additional rush fee may be added, depending on how close the date is. In the event that external circumstances lead to the work not being completed before the specified deadline, the rush fee will be refunded in full.The completed work and its project files (not including source file) will be delivered through VGen or another preferred method upon the receiving the final payment, and work is considered complete. Upon delivery of these materials, the commission agreement is completed.No files will be shared, including test files, before full payment is made.RIGHTS OF USEI may use the finished Work with the purpose of promoting my services, or showcasing it within their professional portfolio. This does not apply to commissions in which an NDA has been included, or until after the permission is included from the client. Works in progress will also be used to promote services.The client may use the work in all private and public projects of their choosing, with the exception of:
- Projects, media, or content related to sensitive or highly-controversial topics including: extreme politics, preaching or deeply religious content, offensive/defamatory content, content that negatively targets a sole or group of individual(s).
- projects, media, or content that imply that the work was created by any party other than the artist.
- AI usage.COMMUNICATIONDiscord is preferred for communication, but VGen's internal messaging is also accepted. The preferenceCommunications must remain professional and respectful. I retain the right to decline and terminate any existing projects, without refund.CONFIDENTIALITYBoth the Client and I agree that they will not disclose any private or sensitive information shared within or pertaining to this commission (such as both parties’ legal name, personal information, situational commission fee information, etc.) to any other party, individual, group, or organization without the written consent of both Parties except for in the case of pursuing legal action. Any breach of confidentiality may result in copyright takedowns of the projects, media, and/or content using the Work, the publicization of breach of confidentiality, and/or pursuing legal action.CONTINUED WORKSThe source file of a live2D rig, or .cmo3, will be saved in cloud storage and local storage, and will be released to the client under one or more of the following conditions:
- An additional payment or other agreement has been made for release
- I am unable to continue a project due to time or health
- I quit rigging altogether
- The client wishes to work with another rig artist, in which case contact will have to be made with the new rig artist and there can be shared communicationWhen it comes to small issues or adjustments, my contact remains open, and payment will not be necessary for any corrections or small adjustments to the finished product!Any adjustments that goes beyond 30 minutes of a simple fix, or a correction of an error, will be time charged. Anything including new content (arm toggles, additional expressions, outfits, hairstyles, etc.) will also be charged as an add-on, and are subject to these terms of service as a new project.
